Spill Prevention
Control and Countermeasure plan requirements were amended in August 2002. All
facilities with SPCC plans must update their plans to reflect the changes and
have the new plan re-certified by an engineer by

US EPA no longer requires underground storage of petroleum to have an SPCC Plan).

The Clean Water Act prohibits the discharge of oil or oily waste into or upon navigable waters of the U.S. or the waters of the contiguous zone, if the discharge causes a film or sheen upon the surface water, or causes sludge or emulsion beneath the water surface. There is a penalty of up to $5000 for violators.
Also-The Clean Water Act prohibits the use of soaps or other dispersing agents to dissipate the oil on the water or in bilges. Fines of $25,000 can be levied per incident of soap use.
