| Tier II (also called Tier 2) Information
North Carolina Annual Filing of Tier II Forms was
due March 1, 2004
Annual
submittal of Tier II forms is required for each (see
marine
fuel (stored underground)
exclusions
below)
facility storing
10,000 lbs. or more of a hazardous substance (roughly 1600 gallons of
gasoline, 1420 gallons of fuel oil, 1480 gallons of kerosene, 1075
gallons of antifreeze, or 1350 gallons of lube oil.)
This
submittal is due March 1, annually, with copies sent to:
(1) Local Emergency Planning Committee; (2) State Emergency
Planning Committee; (NC Emergency Response Commission, 4714 Mail Service
Center, Raleigh, NC 27699-4714) and (3) Local Fire Marshal.
This reporting is required of all facilities, i.e.; bulk plants, warehouses and commercial accounts with applicable storage capacities in retail size containers, cans, drums, pails, ASTs or USTs that exceed the reporting threshold. Some counties require more stringent reporting thresholds and fees.
Exclusions:
In 1999, EPA finalized that public retail outlets such as service
stations, marinas and convenience stores will be exempt from this
requirement. Any retail
(public) gasoline/diesel dispensing facility with total aggregate underground
storage capacities under 75,000 gallons for gasoline and 100,000
gallons for diesel in underground tanks will be exempt from this
reporting requirement. Aboveground tanks storing gasoline, diesel and kerosene
(underground tanks for kerosene also) at retail outlets must still
comply with the 10,000 pound rule and are not exempt regardless of their
locations.
EPA TIER TWO INSTRUCTIONS and Facility Inventory Form
It is quite possible that your business will NOT need to report, because there are minimum threshold criteria for hazardous substances. North Carolina State law permits filing a federal Tier II to meet the requirements of the Hazardous Chemicals Right to Know Act (N.C.G.S. 95-191(b)(1)), reporting the presence of hazardous substances using the lower threshold of 55 gallons or 500 pounds, whichever is greater. If you do not meet Federal thresholds, it not necessary to file a Tier II report with the state. (see http://www.ncem.org/serc/2003faci.pdf).
North Carolina will accept paper copy submissions
generated using the Tier2 Submit software, however, please
only use the "Original Style Paper Report"
option when printing your Tier Two Report. |
