Renown Speakers Add To This Year’s EXPO - Norfolk November 10 - 12
The agenda for this year’s Southeastern Marine
Trades Expo and Conference features many nationally recognized speakers leading
the seminars. Jim Frye of the Marine Operators Association of America will
discuss “ADA Compliance and Non-point Source Pollution Management.”
Mark Amaral of the American Boat Builders and Repairers Association will join
Karl Borgstrom of American Boat and Yacht Council to cover “The Role of
Standards and Training in the Marine Industry.” A panel of Peter Easter,
Virginia Association of Marine Industries, Monita Fontaine, NMMA, Larry Inis,
Marine Retailers Assoc. of America and Mike Sciulla, Boat/US will discuss “Recreational
Marine Industries and Emerging Government Relations.” Thom Dammrich of
NMMA will give the keynote address. Karen Scherberger of Festevents in Norfolk
will talk about “Recreational Marine Industries and Community Economic
Development.” And John McCormack of Alongside Management will present
“Understanding Negotiation Styles.” an interactive
seminar highlighting the practical aspects of customer relationships.
An exhibitor hall with industry products and
services will be open throughout the show and will be the location for an-all
industry reception. A tour of Ocean Marine, a new mega yacht service facility,
training center and marina combination, will also be part of this year’s
conference. Exhibitor and sponsor

EPA
Reaches Out to Marinas
The EPA sent letters to all NC
marinas reminding them to complete Tier II reports, where needed, and also have
appropriate oil spill reporting and response plans in place.
They are giving marinas that have not complied a period of sixty days
(from September 11) to complete either the “Self-Disclosure Policy” or the
“Small Business Compliance Policy.” These forms can be accessed by calling
Ann Heard at EPA (404) 562-9521. Penalties will be reduced for facilities that
voluntarily comply. You can find more information on both reporting policies by

the EPA and were fined for not having filed Tier II reports. Don’t let this

Estuarine
Design and Management Guidebook Series Available
NC Sea Grant has introduced four
guidebooks designed to assist property owners and community planners and
managers in focusing on sustainable design and management. “Soundfront
Series” promotes the design and management options, and awareness and
understanding for long-term health of natural resources. The four guidebooks
in the series range in price from $4-$7 and are available by sending a request
and check to NC Sea Grant, NCSU, Box 8605, Raleigh, NC 27695-8605. The titles
are Shoreline
Erosion in North Carolina Estuaries, Managing Erosion on Estuarine Shorelines,
Protecting Estuarine Water Quality Through Design, and Protecting the Estuarine Region Through Policy and
Management. Books will be available for order online

Design Copyright – Worth Your Trouble
NC boat builders may want to
protect their hull designs by using the copyright protection provided through
the Vessel Hull Design Protection Act. The law grants an owner of an original
vessel hull design certain exclusive rights provided that application for
registration of the design with the Copyright Office is made within two years
of the design being made public. Protection is afforded only to vessel hull
designs embodied in actual vessel hulls that are publicly exhibited, publicly
distributed, or offered for sale or sold to the public on or after October 28,
1998.
The website for registration is http://www.loc.gov/copyright/vessels/ and is fairly easy to use. Most of the applications appear to have photographs as a
component along with the verbal descriptions. The basic application fee for
each design included in the application is $140.

Spill Plans on EPA’s Radar
Word among
marine trade associations is that EPA is going to be looking for Spill
Prevention Control and Countermeasure plans at any inspections they conduct
this year. If your marina or boatyard has at least 42,000 gallons of fuel
stored underground, or 1320 gallons aboveground, you must have this plan and
an engineer must certify it. The
SPCC Plan should address 1) operating procedures that prevent oil spills; 2)
control measures installed to prevent a spill from reaching navigable waters;
and 3) countermeasures to contain, clean up, and mitigate the effects of an
oil spill that reaches navigable waters. Specifically the SPCC plan should
include the following information and should follow the sequence outlined
below:
- A facility which has
experienced one or more spill events within twelve months prior to the
effective date of this part should include a written description of each
such spill, corrective action taken, and plans for preventing recurrence.
- Predictions of the direction,
rate of flow, and total quantity of oil that could be discharged where
experience indicates a potential for equipment failure.
- A description of containment
and/or diversionary structures or equipment to prevent discharged oil from
reaching navigable waters. (For on-shore facilities, one of the following
should be used at a minimum: dikes, berms, or retaining walls; curbing;
culverting, gutters, or other drainage systems; weirs, booms, or other
barriers; spill diversion ponds; retention ponds; sorbent materials.)
- Where appropriate, a
demonstration that containment and/or diversionary structures or equipment
are not practical and a strong oil spill contingency plan and a written
commitment of manpower, equipment, and materials to quickly control and
remove spilled oil.
- A complete discussion of the spill prevention and control
measures applicable to the facility and/or its operations.
