This long and complicated issue is close to final
ruling. The boating industry, especially NMMA’s environmental committee, has
been working on wording that hopefully mitigates some of the adverse impacts and
illogical components of the proposed EPA rules. You can view this set of topics

North
Carolina Commissioner of Labor, Harry Payne, will moderate a session at the EXPO
entitled “OSHA Issues For the Marine Trades and Non-English Speaking
Employee Considerations”. Commissioner Payne’s panel will address State
vs. Federal jurisdiction, inspection priorities, ergonomic rulings, inspections
and best management safety practices for non-English speaking employees. These
state and national issues are of key importance to all marine businesses. The

The DENR Division of Water Quality Planning Branch
was successful in placing the controversial 10-Slip “Marina” Rule for ORW
waters into State Statute. It provides that “the only type of
new or expanded marina that shall be allowed shall be those marinas located in
upland basin areas, or those with less than 10 slips, having no boats over 21
feet in length and no boats with heads”. The word “marina” is in quotes
because marinas are defined across NC as facilities having more than 10 slips.
This rule, now found in the Statues under section 15A NCAC 02B .0225 can
be viewed HERE. This site information also provides the locations of the
ORW sites. The ruling, its finalization, and the speed that it went through the
State’s Administrative Procedures Act has amazed both marina representatives
and costal regulators.

Constructed between 1767 and 1770, this was the meeting place for the colonial
assembly, as well as a residence for William Tryon and his successor British
Royal Governor Josiah Martin. With the Revolutionary War, the palace became a
meeting place for the General Assembly and home to governors of the new state.

The State Department of Transportation will be
digitizing our Coastal Boating Guide for 2001 and this means a short
delay getting them into production – estimated to be in February or March of
2001. There are still plenty of
2000 Guides, but coastal marine businesses should order needed supplies from DOT

On Thursday, November 9th at 11:30 AM in the
Sheraton, both the North Carolina Marine Trade Association and the South

The
Coastal Resources Commission, in its September 29th meeting in New
Bern, agreed to a set of three requests favored by coastal urban waterfront
communities. The Commission voted in favor of the following: 1). A property
owner could add additional floors to an existing enclosed building, as long as
the addition did not increase the structure's original footprint. 2). Decks
could have roofs, as long as the decks were a single story and did not have any
kind of walls. The Commission voted against the following proposal: “Structures
could not degrade critical habitat areas, as defined by the state Marine
Fisheries Commission” because they did not have a definition they could agree

On Thursday, November 9th, at 4:30 PM in the Sheraton, two marine industry forums will be underway for purpose of discussing and refining issues that need additional attention, understanding and appreciation from state regulators, legislators, and litigators.
The Boat Building Forum will have involvement
from participants including Hatteras Yachts, Grady-White Boats, Bennett Brothers
Yachts, Mann Custom Boats, Parker Marine, Jones Brothers Boats, World Class
Cats, C-Hawk Boats, Davis Boatworks, Albemarle Boats, Regulator Marine, Rampage,
and Fountain Power Boats and many other businesses. Attend and participate.
In the first half of the Marina and Boatyard Forum
a guest speaker will focus on innovative means to provide better service and
gain more customers. Customers must consistently pay more to cover increasing

comments on other issues that are affecting this industry, with Nancy Schilling
